1. Acceptance of Terms

By accessing or using https://lejardinnj.com (the "Site") or any services offered by LE JARDINE JK LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

2. Description of Service

Le Jardin Kitchen provides access to recipe content, a kitchen goods store, and a subscription service ("Membership") that unlocks premium recipe content. Some content is available free of charge; other content requires an active paid Membership.

3. Account Registration

To purchase products or subscribe to Membership, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account at info@lejardinnj.com.

4. Subscription Billing and Auto-Renewal

Membership is offered on a monthly ($24.99/month) or annual ($169.99/year) basis. All new memberships begin with a 30-day free trial. Your payment method will not be charged during the free trial period. After the trial period ends, your subscription will automatically renew at the applicable rate unless you cancel before the renewal date.

By starting a subscription, you authorize us to charge your payment method on a recurring basis at the applicable rate until you cancel. Renewal charges occur at the start of each billing period. Prices are in US dollars and are subject to change with 30 days written notice to subscribers.

5. Cancellation

You may cancel your subscription at any time by logging into your account and following the cancellation instructions, or by emailing info@lejardinnj.com. If you cancel during a free trial, you will not be charged. If you cancel after a paid period has begun, your access continues until the end of that paid period. No partial refunds are issued for unused time except as provided in our 30-day money-back guarantee.

6. Refunds

We offer a 30-day money-back guarantee on Membership subscriptions. If you are not satisfied within 30 days of your first paid charge, contact us at info@lejardinnj.com and we will issue a full refund. For physical products, see our Refund Policy.

7. Intellectual Property

All content on the Site -- including recipes, photographs, articles, logos, and design elements -- is the property of LE JARDINE JK LLC or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Site content without our express written permission. Personal, non-commercial use of recipes for home cooking is permitted.

8. User Conduct

You agree not to: use the Site for any unlawful purpose; share your Membership credentials with other users; attempt to reverse engineer, scrape, or copy the Site's content in bulk; impersonate any person or entity; or engage in any conduct that interferes with other users' enjoyment of the Site.

9. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NUTRITIONAL INFORMATION PROVIDED IS APPROXIMATE AND NOT INTENDED AS MEDICAL ADVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LE JARDINE JK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE OR ITS CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS OR (B) $50.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws provisions. Any dispute arising under these Terms shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in New York County, New York. You waive any right to participate in a class action lawsuit or class-wide arbitration against the Company.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify subscribers by email of material changes at least 15 days before they take effect. Your continued use of the Site after the effective date of revised Terms constitutes acceptance.
